TERMS & CONDITIONS HERTZ MINILEASE All rates for cars and vans are only valid at rental locations in Belgium and Luxembourg.

1. Rental Period
The rental period charged would be the period from the time that the Hertz rental agreement is “stamped” with time and date by a Hertz employee and the moment the car is returned and checked-in by a Hertz employee. In the event that the vehicle requires collection from a location other than a Hertz location, the rental will be deemed to have terminated at the time that the Company renter advises the nearest Hertz location in writing. When the car is left at another premise, the renter remains responsible for the vehicle until an appraisal of the car is made upon collection of the vehicle by a Hertz employee. When the car is delivered, a representative of the company will sign a document (see attachment) in which the time of delivery is mentioned and as from that moment the company is responsible for the car until the car is collected. If the car is being used without rental agreement, no protections will be valid and the company is responsible for all damages, traffic fines, etc. The rental period runs of one rental day (i.e. the 24 hour period starting from the time the rental agreement commences).
2. Delivery and Collection
Hertz will provide a delivery and collection service to the Customer's office within BE/LUX (except for Brussels airport). The Hertz representative will wait a maximum of 30 minutes for the driver or the person appointed by the driver to collect the keys and sign a document with exact time of delivery or collection.
If nobody shows up within this time period, the Hertz representative will return to his base with the car. A fee as set out below will also apply in that case. If a delivery or collection is cancelled less than 3 hours before the commencement of the agreed rental period or at any time after the delivery or collection time indicated on the rental agreement, a cancellation fee will be charged.
Per delivery/collection: 0-9 km: € 12 10-19 km: € 18 20-29 km: € 35 30+ km: € 1.20 per km
3. One Way Rentals\RIH-LIT
The facility to rent at one Hertz location and return to another Hertz location within Belgium and Luxembourg will be provided without inter-city fee for cars and with inter-city fee of € 25 for vans.
4. International RIH-LIT
One way rentals to other countries are not allowed on these rates. RIH/LIT is not possible for some countries and/or car groups. Please check at time of reservation.
5. Location Service Charges
At certain locations a Location Surcharge may apply. This is subject to amendment without notice. Confirmation at time of booking is recommended. A charge of 20% per day of the daily rate including CDW, TP, PI, Refuelling and RIH-LIT with a minimum charge of € 42 per rental will be made at all airports and all train stations. A charge € 25 per rental will be made at our Brussels Downtown office.
6. Driver Age Limit - Young driver surcharge
For Business rentals (on contract rates only), the minimum renting age is 21 years old. Between 21 and 25, a surcharge of € 20 per day, with a maximum charge of 10 days will apply.
7. Traffic Fines
An administration fee of 25 € (excl.VAT) will be charged with any traffic fine or any other penalty. In case of damage a charge of 30 € (excl VAT) will apply.
8. Additional Driver Charges
The following additional driver charges will apply in Belgium and Luxembourg: € 24.00 per driver excluding Tax.

10. Payment Terms & Legal Conventions
The payment terms under our General Trade Conditions (art.3) are: net 30 days date of invoice. Payment by draft is not allowed. Payment should be done by credit cards. For the Prestige Collection, 2 credit cards are needed. Renting on account is on request, a credit check will then be carried out. Any overdue invoice will be subject to the legal interest charge, notwithstanding our right to claim the contractual indemnity for administration and collection fee of 15%. The fee will be due on all overdue invoices, with a minimum of € 74.37 and this without prior registered notice being mandatory. Exceptions to these payment terms can only be accepted and agreed in writing between both parties. Any claim regarding an invoice or a rental agreement must be made in writing within 10 days starting from the date of invoice. With reference to art. 13 of our General Trade Conditions, please note that all disputes will be handled by the court of Brussels or Luxembourg, each following their own legislation. The full text of our General Trade Conditions is printed at the back of each rental agreement.
11. Catastrophe Clause
In the event that abnormal business circumstances arise beyond the direct control of Hertz, Hertz will have the right at any time upon thirty (30) days prior written notice to propose a modification of rates. Such modifications will be deemed to have been accepted unless the customer declines such writing at least fourteen (14) days prior to the effective start date. In the event that an agreement can not be reached, Hertz reserves the right to terminate the agreement with thirty (30) days written notice. The price guarantees in this agreement are given on the basis that normal business circumstances prevail.
12. Breakdown Service
Hertz offers a 7/7 24/24 breakdown service. This service can be reached via following telephone numbers: BE : 0800 13465 et LU : 0800 23272.
RENTAL TERMS AND CONDITIONS
Hertz Belgium B.V.B.A. rents the vehicle (including any replacement vehicle) to you subject to the terms and conditions on the front page and these pages, and you agree to them and confirm that you will strictly comply with them. You should be aware that it is our intention that all terms of the contract between us are contained in this document. Please read it carefully. If there is anything you do not understand or do not agree with, please ask.
1. DELIVERY AND RETURN
The vehicle is in good overall and operating condition and without apparent defects and you agree that you will return it to us in that same condition with all documents, parts and accessories at the location and on the date and time designated in this agreement. We can take back the vehicle at any time without telling you and at your expense in case of breach of this agreement.
2. YOUR RESPONSIBILITY
Subject only to 2(a)(i) and (ii), in the event of damage to, or loss or theft of the vehicle, its parts or accessories while on rental, you must pay us on demand the amount of all costs and losses incurred by us including but not limited to the cost ofrepairs, loss in value, loss of rental income and towing and storage charges.
a) Provided that you comply with all the terms of this agreement and provided that the loss or damage is not caused intentionally, or by the gross negligence of you or an authorised driver, or by any unauthorised driver, then your liability may be limited as follows:
(i) If you accept the optional Collision Damage Waiver (CDW) by paying the daily charge specified, your liability for loss of or damage to the vehicle, its parts or accessories (other than caused by theft), is limited to the amount of the non-waivable excess stated on the front page.
(ii) if you accept the optional Theft Protection (TP) by paying the daily charge specified, your liability for loss of or damage to the vehicle, its parts or accessories as a result of theft, is limited to the amount of the non-waivable excess stated on the front page. You agree that we may debit your credit or charge card with the above amount(s) for which you are responsible and that we may charge you the costs of any repairs. You are fully responsible for damage caused by striking overhead or overhanging objects. Such damage is not covered by CDW or any other waiver.
3. OUR RESPONSIBILITY
We shall not be liable for any loss or damage suffered by you unless we are grossly negligent. Nothing in these terms shall exclude or restrict our liability for death or personal injury resulting from our negligence or any other liability which cannot be excluded as a matter of law. Our responsibility shall not at any time exceed €2,000,000.
4. CHARGES
All charges stated on the front page are calculated in accordance with our current tariff and on the basis of your use of the vehicle as specified. Unauthorised use may incur additional charges as published in our current tariff.
You agree to pay on demand:
(a) The rental and all other ancillary charges, such as CDW, TP, additional drivers, delivery and collection, one way drop and taxes. The minimum rental charge is for one rental day except as stated below; a rental day consists of a 24 hour period starting when the rental begins. In the event of a late return of the vehicle exceeding 59 minutes, we reserve the right to make an additional daily charge at the relevant daily rate.
You may rent a van for a single, half-day rental consisting of a 12 hour period starting when the rental begins. If the van is returned more than 59 minutes late we reserve the right to make an additional half day charge. If the vehicle is returned more than 24 hours after the rental begins we may make additional daily charges at the relevant daily rate. Half-day rentals may not be combined under any circumstances to produce a longer period of rental.
b) Any charge for damage outlined in clause 2 including the non-waivable amount. A loss of revenue charge may be levied, based upon our tariff daily rate, unless you have opted to accept CDW and/or TP.
c) A refuelling/service charge if you return the vehicle with less than a full tank of fuel, unless you take the Fuel Purchase Option at time of rental.
d) Applicable taxes at the prevailing rate.
e) If you are in default of payment, you are liable, without formal notice, to default interest in addition to the outstanding charges at the statutory interest rate and also for all our costs of collecting the unpaid charges or 15% of the amount of the outstanding charges, whichever is the greater.
All complaints or objections to charges must be brought to our attention no later than 30 days after receipt of the final statement of account, otherwise the statement will be conclusive. All charges are subject to final determination after the rental. You authorise us in advance to debit any charges pursuant to this agreement from your credit or charge card account including our reasonable legal costs of recovering the charges.
5. VIOLATION OF TRAFFIC REGULATIONS
You are fully responsible for all fines and any consequences of the violation of traffic regulations and parking orders or prohibitions during the rental. If Hertz is required to pay such fines, you agree that we may debit your credit or charge card during the rental or after the return of the vehicle with the amount of any fine plus an administrative charge of 10% of the fine(s) or € 25 whichever is the greater . We shall, upon request, supply you with a copy of any traffic violation notice which we receive.
6. INDEMNITY
To the extent allowed by law, you agree to indemnify us against any claims in connection with the operation of the vehicle, any damages suffered by you, including, without limitation, the fines and other consequences referred to in clause 5 above, or any matters which are your responsibility. We expressly disclaim any liability for damage or loss of any kind suffered by you or any third party, unless we are at fault.
7. CONDITIONS OF USE
You must look after the vehicle, making sure it is locked and secure when not in use; use the correct fuel and set and use any security device fitted. In the case of cars, you must not leave any property visible inside the car whenever it is left unoccupied. You must not use or allow the vehicle to be used:
a) to carry passengers for remuneration; b) except in the case of trucks and vans, to carry cargo for remuneration; c) to propel or tow any vehicle, trailer or other object; d) to take part in any race, rally, test or other contest; e) while the driver is under the influence of alcohol, drugs or any other substance impairing his or her consciousness or ability to react; f) in contravention of any traffic regulations - note that committing any traffic offence is a violation of this agreement; g) if you do not fulfil the minimum requirements as stipulated in our current tariff regarding age and the possession of a current driving licence which is valid for the type of vehicle rented; h) by any other person who has not first been authorised by us and added to this agreement and who does not also fulfil the minimum Hertz requirements regarding age and possession of a valid, current driving licence. In such cases, you are also responsible for the use of the vehicle according to this agreement and to indemnify us pursuant to Clause 6 above; i) for sub-renting; j) to drive or be driven in restricted areas, including in particular on airport runways, airport service roads and associated areas;
k) to carry dogs or other animals. If you fail to observe this restriction, you will be liable to pay us the sum of € 250 or the actual costs of cleaning and, if necessary, repairing the vehicle, whichever is the greater.
Vehicles may only be taken or driven into or in the following countries:Andorra, Austria, Belgium, Denmark, Finland, France, Germany, Gibraltar, Italy, Liechtenstein, Luxembourg, Monaco, Netherlands, Norway, Portugal, Republic of Ireland, San Marino, Spain (not including the Spanish Enclaves of Ceuta and Melilla), Sweden, Switzerland and the United Kingdom (including Northern Ireland). Mercedes or BMW cars and convertibles of any make or model must not be taken or driven into or in Italy. The prior consent of Hertz is needed for journeys into any other countries.
8. INSURANCE
We provide insurance coverage for persons using the vehicle with our permission (and not otherwise) in accordance with an automobile liability insurance policy a copy of which is available upon request. This policy meets all legal requirements and protects the owner and/or any authorised driver of the vehicle against legal claims from third parties for personal injury or material damage caused by the use of the vehicle. The conditions of the insurance contract, including any territorial restrictions, are incorporated as an integral part of this agreement. Note that we have the right to claim re-imbursement from you for any payments made or losses suffered by us or our insurers as a result of your breach of a material term of this agreement.
9. ACCIDENTS
You must report any traffic accident, loss, damage or theft to the police immediately and to us within 24 hours. You must not admit liability or guilt in the event of an accident. A Hertz accident or theft report form must always be completed and submitted to us. If you do not comply with this request, CDW and/or TP will be void.
You agree to co-operate with us and our insurers in any investigation or subsequent legal proceedings.
10. PERSONAL INSURANCE
You can accept Personal Insurance by initialling the space provided on the front page and paying the applicable premium. The terms and conditions applying to Personal Insurance are contained in a master policy placed with Probus Insurance Company Europe Ltd (PI6700.0002) a copy of which is available upon request. By accepting Personal Insurance you are agreeing to the terms and conditions of the master policy. A summary of the cover provided is set out in a leaflet which is available from each rental station.
11. PERSONAL PROPERTY
We are not liable to you or any passenger for loss or damage to property left in the vehicle either during the period of hire or thereafter. Such property is entirely at your own risk, unless covered by Personal Insurance as outlined above.
12. PERSONAL DATA
You consent to the computer storage and processing of your personal data by us in connection with this agreement and to the transmission of this data among the Hertz group of companies and its business partners (where permitted) for the purposes of our legitimate interests including statistical analysis, marketing of our services and credit control. If you breach this agreement your personal data may be disclosed or passed to third parties to the extent necessary to assist recovery procedures.
13. LAW AND JURISDICTION
We aim to resolve all disputes amicably. If this is not possible, the law of the country where you signed the Rental Agreement will apply and the courts of that country will have jurisdiction. If any dispute falls under the jurisdiction of the district court it shall be heard exclusively by the district court of Amsterdam. In case of any inconsistency or difference between the English and Dutch text, the Dutch text will prevail.
